General terms and conditions of sale
Collection of lamps and light sculptures · version of 12 October 2026 · This English version is provided for convenience; the French version prevails.
1. Purpose
These terms govern the sale, on the website phld.fr (“Collection” pages), of the lamps and light sculptures of the Philosophie de Lumière collection, designed by Olesya Tarasova and made to order, by Philosophie de Lumière SARL (“the studio”), a SARL with a share capital of €5,000, 10 avenue du Trayas, 06590 Théoule-sur-Mer, France, RCS Cannes 828 241 166, VAT FR 28 828 241 166, tarasova@phld.fr, +33 7 51 62 06 94.
They apply to sales to private individuals and to professionals alike. One-off pieces and bespoke orders (dimensions, shape, finish or light defined with the customer) are subject to a quotation and to specific terms, which take precedence over these terms.
2. The pieces
Each piece is sculpted, cast or assembled and finished by hand, in France, after the order is placed. The essential characteristics (materials, dimensions, finishes, light source, lead time) are stated on the product page of each piece.
Handwork makes each copy slightly different from the others and from the photographs: variations in texture, in the shade of the plaster or the patina, tool marks. These variations are part of the piece and do not constitute a defect.
Some pieces are issued in a limited, numbered edition (for example 22 copies). The number is allocated in the order in which orders are received and is shown on the piece or its certificate.
The lamps are fitted with LED light sources and power supplies that comply with the applicable European directives (CE marking). They must be installed and connected by a qualified electrician, in accordance with the instructions supplied.
3. Prices
Prices are stated in euros, inclusive of all taxes (French VAT at 20%). Delivery is included in the price within metropolitan France, the European Union and Switzerland. For any other destination, delivery costs are subject to a quotation accepted by the customer before the order is placed.
A professional holding a valid intra-Community VAT number, or a buyer whose order is delivered outside the European Union, pays the price exclusive of taxes. For delivery outside the European Union, customs duties, import taxes and customs clearance fees of the country of destination are borne by the buyer.
The applicable price is the price displayed at the time of the order.
4. Order and payment
Orders are placed online and paid by bank card or digital wallet, through the payment provider Stripe. The studio neither receives nor stores card details.
A deposit of 70% of the price is paid when the order is placed. The balance (30% of the price) and, where applicable, the delivery costs set out in the quotation are paid before dispatch: at the end of production, the studio sends the customer a notice together with a payment link. The piece is dispatched as soon as the balance is received. If the balance is not paid within 15 days of that notice, the studio may, after a formal notice that has remained without effect for 8 days, rescind the sale; the deposit is then refunded, less the costs actually incurred for production, for which evidence is provided to the customer.
The contract is concluded upon confirmation of payment. The customer then receives by e-mail an order confirmation setting out the piece, the price, the deposit paid, the balance outstanding, the stated lead time and these terms, together with a deposit invoice; the final invoice follows payment of the balance.
The studio may refuse an order in the event of a previous dispute with the customer or where delivery to the address given is impossible; the customer is then refunded in full.
5. Production and delivery time
Each piece is made after the order is placed. The lead time stated on the product page (generally 3 to 5 weeks) runs from payment of the deposit and covers production and shipping within metropolitan France. For other destinations it is extended by the transit time, which is stated before payment.
The time elapsed between the notice that production is complete and payment of the balance is added to this lead time. The studio informs the customer by e-mail when the piece is dispatched and sends the tracking number.
If the lead time is exceeded, a consumer customer may, after requiring the studio in writing to deliver within a reasonable additional period, terminate the contract if the piece is not delivered within that period (Article L216-6 of the French Consumer Code). The customer is then refunded within 14 days.
6. Delivery and carriage
The pieces are packed at the workshop in a reinforced cardboard box, wedged to protect the plaster, and shipped by carrier with tracking and insurance.
Delivery zones: within metropolitan France, the European Union and Switzerland, delivery is included in the price; for the rest of the world, delivery costs are subject to a quotation, drawn up and accepted before the order is placed.
For a consumer customer, the piece travels at the studio's risk until it is handed over to the customer (Article L216-4 of the French Consumer Code). On receipt, the customer checks the condition of the parcel in the presence of the delivery driver and, if the packaging is damaged, records specific reservations on the delivery note. In the event of damage, the customer notifies the studio within 3 days, with supporting photographs, at tarasova@phld.fr: the studio arranges for the piece to be repaired or replaced, at its own expense.
7. Right of withdrawal
A consumer customer has 14 days from receipt of the piece to withdraw from the contract, without having to give any reason (Article L221-18 of the French Consumer Code). The customer informs the studio of the decision by an unequivocal statement, by e-mail to tarasova@phld.fr or using the form set out in the annex.
The piece must be returned no later than 14 days after the customer has communicated the decision, complete, in its original packaging or in packaging offering the same protection. The cost of return is borne by the customer. As the pieces cannot be returned by post because of their weight and fragility, their cost of return is estimated at a maximum of €120 including VAT from metropolitan France, the European Union or Switzerland; for other destinations, at the amount of the delivery costs set out in the quotation.
The studio refunds the sums paid (deposit, balance and, where applicable, the delivery costs set out in the quotation) within 14 days of the withdrawal, using the same means of payment; it may withhold the refund until it has received the piece back. The customer is liable for any diminished value of the piece resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning (for example a piece that has been installed, drilled, painted or modified).
In accordance with Article L221-28, 3°, of the French Consumer Code, the right of withdrawal does not apply to pieces made to the customer's specifications or clearly personalised: dimensions, shape, finish, colour or light chosen outside the options offered on the product page, one-off pieces and orders placed on quotation. The product page or the quotation states this before the order is placed.
The right of withdrawal is reserved for consumers: it does not apply to purchases made by a professional for the purposes of their business.
8. Legal guarantees
A consumer customer has two years from delivery of the piece to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared. The legal guarantee of conformity entails an obligation for the seller, where applicable, to provide all updates necessary to keep the goods in conformity. It entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced. The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if the seller refuses to repair or replace the goods, if the repair or replacement of the goods does not take place within thirty days, if the repair or replacement of the goods causes major inconvenience to the consumer, or if the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity. The consumer is also entitled to a reduction of the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to request repair or replacement of the goods first. The consumer is not entitled to terminate the sale if the lack of conformity is minor. Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered. The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code). The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
The variations inherent in handwork described in clause 2 do not constitute a lack of conformity. The guarantees do not cover damage caused by installation not in accordance with the instructions, by impact, by moisture, or by modification of the piece.
The LED light source and the power supply are covered by these legal guarantees, like the rest of the piece; the studio does not grant any additional commercial guarantee.
9. Installation and use
The electrical connection must be carried out by a qualified electrician, in accordance with the standards in force and the instructions supplied. The pieces are intended for indoor use, unless otherwise stated on the product page. Plaster and natural finishes are sensitive to water and impact: clean them dry, with a soft brush.
10. Intellectual property
The designs and models of the pieces, their photographs and their names remain the property of the studio. The purchase of a piece confers no right to reproduce or exploit it. The studio may show the piece in its installed setting anonymously, without the customer's address or name, unless the customer objects in writing.
11. Personal data
The processing of data relating to the order (identity, contact details, delivery address) is described in the website's privacy policy. Payment data is processed by Stripe.
12. Complaints and mediation
Any complaint may be sent to tarasova@phld.fr. A consumer customer may refer the matter, free of charge, to the following consumer mediator (Article L612-1 of the French Consumer Code), after a written complaint to the studio that has not been satisfactorily resolved, and no later than one year after that complaint: CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice (a consumer mediation centre), 49 rue de Ponthieu, 75008 Paris, www.cm2c.net.
13. Governing law
These terms are governed by French law. A consumer customer may bring proceedings, at their choice, before the court of the place where they resided at the time of the order or before the court of the studio's registered office; they also benefit from the mandatory provisions of the law of their country of residence where these are more favourable to them.
